This is an application for bail in a case of misuse of privilege of bail.

The petitioner being the husband of the complainant is languishing in custody since 14.06.2016 in a complaint case filed for the offences punishable under sections 498A, 494, 380, 323, 504/34 of the Indian Penal Code wherein in process has been directed to be issued after cognizance being taken.

It is submitted by learned counsel for the petitioner that the petitioner was earlier granted custody bail but he failed to appear on 26.03.2012 before the learned Court below when his bail bond was cancelled. It is further submitted that now the

Considering the nature of accusation and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gaya, in connection with Complaint Case No.1808/2007 (Trial No.450/2016).

However, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for three consecutive occasions.
