JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304B and 201/34 of the Indian Penal Code. Allegation against the petitioner is of torturing and killing sister of the informant due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that he is in custody since 3.12.2015. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. No offence under Section 304B of the Indian Penal Code is made out.

The alleged occurrence has taken place after seven years of marriage. Subsequently, a petition has been filed on behalf of the informant before the court below stating that the case was instituted due to mistake of fact. The said petition is Annexure-3 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.29253 of 2016 (3) dt.01-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VI, Purnea , in connection with Tikapatti P.S. Case no. 133 of 2015.
