2. The petitioner has prayed for bail in connection with Hasanpur P.S. Case No.59 of 2025 registered for the offence punishable under Section 309(4) of the B.N.S.
3. The case of the prosecution is that three unknown miscreants have snatched the mobile, cash and bike of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name has surfaced during investigation in the confessional statement of one co-accused Radho Kumar. It has also been submitted that though charge-sheet has been filed, no
Patna High Court CR. MISC. No.50243 of 2025(3) dt.16-10-2025 2/2 T.I.P. has been conducted regarding the bike. It has also been submitted that this case is triable by the learned Judicial Magistrate. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 18.04.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that the stolen bike was recovered from the house of this petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 59 of 2025.
