The petitioners seek bail in a case instituted under Sections 396 and 397 of the Indian Penal Code. Allegation is that the accused persons have committed dacoity in the house of the informant.

It has been submitted on behalf of the petitioners that the petitioner no.1 Gulteni Nut @ Ashok Nut is in custody since 28.03.2016 and petitioner no.2 Bablu Nut @ Bablu Yadav is in custody since 15.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in

Patna High Court Cr.Misc. No.32497 of 2016 (3) dt.20-09-2016 2/2 the First Information Report. They have not been put on Test Identification Parade. There is no recovery of any looted article from the possession of the petitioners. The names of the petitioners have come on the basis of confessional statement of coaccused. Other co-accused has been granted bail vide Cr. Misc. No. 32947 of 2016 and 29367 of 2016.

On behalf of the state it has been submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Saran at Chapra, in connection with Sonepur P.S. Case No. 102 of 2016.
