Petitioner seeks bail in connection with Rajoun P.S. Case No. 270 of 2018 registered for the offence punishable under sections 431 and 379 of the Indian Penal Code and Section 4/40 B.M.M.C. Rule 1972, Section 6/4 and 8(d) of Bihar Minerals (Prevention of illegal Mining Transportation and Storage Rule 2003).

Learned counsel appearing for the petitioner submits that merely on suspicion petitioner has falsely been implicated in this case. There is no eyewitness and no one has seen lifting the sand in question from the river. Petitioner has no criminal antecedent and is in custody since 22.06.2018. Considering the facts and circumstances of the case

No.56423 of 2018(2) dt.20-09-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Rajoun P.S.
