The petitioner seeks bail in anticipation of his arrest in connection with Kotwali (Barari) P.S. Case No. 1005 of 2019 dated 14.11.2019 instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. On secret information that some miscreants have assembled for committing dacoity, a raid was conducted. One Kailash Yadav is said to have been arrested with firearm weapons. He is said to have confessed before the police naming the petitioner as well.

No.8498 of 2021(2) dt.17-12-2021 2/2 The learned counsel for the petitioner has submitted that but for confession of aforesaid Kailash Yadav who is on inimical term with him, there is no other material to connect the petitioner with the offence. The petitioner has clean antecedents.

Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 1005 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
