2. The petitioner seeks bail in connection with Dalsingsarai P.S. Case No. 501 of 2023 registered for the offences under Sections 394 and 302/34 of the IPC.
3. The petitioner is not named in the F.I.R. and is in custody since 13.04.2024.
4. As per FIR some unknown persons committed dacoity in the house of informant and looted domestic items, jewelries and also committed murder of wife of informant by way of strangulation.
5. Learned counsel appearing on behalf of the petitioner submitted that name of this petitioner transpired in this case
Patna High Court CR. MISC. No.53056 of 2025(2) dt.17-09-2025 2/3 during the course of investigation on the basis of confessional statement of apprehended co-accused, in furtherance of which nothing incriminating surfaced/recovered as to connect this petitioner prima-facie with the present crime in question. It is submitted that no TIP was conducted as yet. It is also submitted that similarly situated co-accused has already granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 21139 of 2025 vide order dated 09.05.2025 and, therefore, as a matter of parity this petitioner also deserves bail. While concluding the argument it is submitted that, petitioner is a man of clean antecedent and moreover, investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.
6. Learned APP appearing on behalf of the State, while opposing the prayer for bail could not dispute aforesaid factual submission.

In view of aforesaid factual submission and by taking note of fact as prima-facie save and except suspicion arising out of confessional statement of apprehended co-accused nothing incriminating transpires against this petitioner as to connect him with the present crime in question, coupled with the fact as petitioner remains in custody since 13.04.2024, accordingly above
Patna High Court CR. MISC. No.53056 of 2025(2) dt.17-09-2025 3/3 named petitioner, is directed to be released on bail in connection with Dalsingsarai P.S. Case No. 501 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge, Dalsingsarai, Samastipur/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
