JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 420 of the Indian Penal Code.

It is alleged that co accused Raju Paswan was agent of Jyoti Marketing Private Ltd, a non-banking financial company and he used to conduct sale of lottery ticket. The complainant deposited Rs.60/- per month for thirteen months and the complainant won the prize of motorcycle. Subsequently the complainant went to the petitioner and deposited Rs.5750/- as VAT amount but the prized motorcycle was not given.

Considering the nature of accusation ventilated through complaint, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Katihar in connection with Complaint Case No. 2711 of 2010 subject to the conditions as laid down under Section 438(2) Cr.P.C.
