JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-01-2024 The present writ petition has been filed seeking the following reliefs:- "a) For issuance of order/orders, direction/ directions or writ/writs in the nature of Certiorari for quashing and setting aside the order dated 02.08.2019 contained in Memo No. 1213 passed by the District Programme Officer, Purnea whereby the selection of the petitioner to the post of Anganwadi Sevika for Gram Panchyat Ladhugarh, Ward No.01,

Patna High Court CWJC No.12646 of 2023(2) dt.08-01-2024 2/3 Banmankhi, Purnea has been cancelled and the Child Development Progam Officer, Banmankhi has been directed to conduct the selection process after publishing the fresh advertisement for the aforesaid centre.

b) For issuance of writ in nature of Certiorari for quashing the order dated 18.04.2022 read with order dated 26.05.2023 contained in Memo No.2165 passed by the Divisional Commissioner, Purnea whereby the Anganwadi Appeal No.13/2019 filed by the petitioner has been rejected and the petitioner has been directed to approach before the competent authority for redressal of her remedy.

c) For issuance of a direction to the Respondent Authorities to select the petitioner to the post of Anganbadi Sevika for Ward No. 01, Ladhugarh Panchyat, Banmankhi, Jankinagar, Purnea as she has secured the highest marks and was placed at serial no.1 in the merit list and further Stay the operation of the impugned order contained in Memo No.1213 dated 02.08.2019 passed by the District Programme Officer, Araria."

At the outset, the learned counsel for the petitioner seeks not to press the present writ

Patna High Court CWJC No.12646 of 2023(2) dt.08-01-2024 3/3 petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
