JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Though, petitioner was armed with pistol but never aimed. On the other hand, there happens to be allegation that Arvind Kumar Singh along with Lakhan Mahto threw the informant on ground and then, began to assault with rod whereupon, he ran therefrom. So far injury over head is concerned that allegation has been attributed against Mukesh Mahto to have given by butt of the pistol. From Annexure-2 as well as going through the order impugned, it is evident that single lacerated wound at frontal head 1 1/2 " x 1⁄4" x 1⁄4", simple in nature caused by hard and blunt substance has been found.

In the aforesaid background, petitioner is directed

Patna High Court Cr.Misc. No.53847 of 2018 (2) dt.13-09-2018 to surrender before the learned lower court with a prayer for bail which the learned lower court will consider in light of finding as recorded hereinabove, favourably and with the aforesaid observation, instant petition is disposed of.
