The petitioner seeks bail in connection with Athmalgola P.S. Case No. 317 of 2018 dated 11.12.2018 instituted for the offence under Sections 341, 323, 324 and 307 of the Indian Penal Code. The accusation against the petitioner is of assaulting the victim by means of a sharp-cutting weapon on his head. The nature of injury has yet not been ascertained.

The petitioner is in custody since 08.06.2022. From the impugned order as also from the arguments advanced on behalf of the petitioner, it appears that he was granted anticipatory bail by the

Patna High Court CR. MISC. No.52046 of 2022(2) dt.23-12-2022 2/2 court below but because he could not surrender within time, he was arrested and now his regular bail petition has been rejected.

Regard being had to the period of custody of the petitioner with the background of nature of allegation and taking into account that prior to this case, he was made accused in only one case in which he is on bail, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 317 of 2018.
