1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 109, 126(2), 115(2), 118(1), 117(2), 324 and 3(5) of the BNS, 2023.

3. The Investigating Officer of the case, in compliance of the order dated 02.09.2025, is present in the Court along with the injury report of the injured.

4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant, Munna Kumar Singh, alleges that on 28.02.2025 at 03:30 PM, his brother and father had parked their tractor loaded with sugarcane near the road and had come home, thereafter Raju Singh's tractor driven by his labour, Bitu Mahto intentionally

No.52735 of 2025(3) dt.08-09-2025 2/3 rammed into the informant's tractor damaging its glass, number plate and light, on protest the accused persons assaulted him with lathi, danda, rod and Hansua, it is next alleged that Mangru Mahto assaulted him by Hansua causing injury on head and thereafter Hira Mahto assaulted him by Hansua causing injury on neck.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that on account of dispute relating to dashing of tractor, the occurrence is alleged to have taken place, on account of which an altercation took place in which both sides assaulted each other, even the side of the petitioner were also injured. It is further submitted that the injury suffered by the injured has been opined to be simple in nature.

6. The Investigating Officer of the case, who is present in the Court, also submits that the injury suffered by the injured has been opined to be simple in nature.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner and the Investigating Officer of the

No.52735 of 2025(3) dt.08-09-2025 3/3 case, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pipra P.S. Case No. 88 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

9. The personal appearance of the Investigating Officer of the case is dispensed with.

10. Accordingly, the instant anticipatory bail application is allowed.
