The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420/34 of the Indian Penal Code, 7 of the Essential Commodities Act and 7/35 (i) (B) of the Fertilizer (Control) Order, 1985.

It is alleged that petitioner was intercepted while driving a truck having loaded with 600 bags of fertilizers. It is submitted by the learned counsel for the petitioner that the petitioner was carrying the same under the valid purchase invoice as truck of the petitioner was hired, but the invoice was wrongly treated as forged one. It is submitted that assuming the accusation, no case is made out against the petitioner since he is only a driver-cum-owner of the truck.

Patna High Court Cr.Misc. No.19311 of 2015 (2) dt.29-04-2015 Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea in connection with K. Hat Maranga P.S. Case No. 111 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
