====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard the parties through video conferencing. Petitioner seeks regular bail in connection with Sakri P.S. Case No. 60 of 2022 corresponding to C.R.I. No. 427 of 2022 registered under Section 356, 379 / 34, 395, 120(B) of the I.P.C.

As per the prosecution story the informant was intercepted by three persons riding on a motorcycle and they snatched the bag from the informant containing Rs. 4,70,000/- Learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged and he has falsely been implicated in this case on the basis of the confessional statement of the co-accused / Prince Kumar Paswan. He next submits that petitioner has been remanded in this case from

Patna High Court CR. MISC. No.51678 of 2022(2) dt.09-12-2022 2/2 Pandaul P.S. Case No. 55 of 2022. The petitioner is in custody since 19-04-2022, charge sheet has already been submitted but no T.I. Parade has been conducted by the prosecution till now. Regard being had to the submissions made by the parties, taking into consideration the fact that petitioner is in custody since 19.04.2022, no T.I.P. has been conducted by the prosecution and no incriminating and / or looted article has been recovered from the possession of the petitioner, and as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000 /- ( twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.

, Madhubani in connection with Sakri P.S. Case No. 60 of 2022 corresponding to C.R.I. No. 427 of 2022 on the condition that the petitioner shall remain physically present on each and every date during the course of trial and in case of default on two consecutive dates, his bail bond shall liable to be cancelled.
