JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 504, 506, 324, 307, 379/34 of the Indian Penal Code.

Allegation against the petitioner is that he gave Hasua blow on the hand of the informant causing injury between thumb and flung and that started bleeding. It is further alleged that the petitioner also assaulted on his chest with Hasua which caused a big injury and he fell down.

He submits that the father of the petitioner has filed a Title Suit bearing Title Suit No. 51 of 2019 in which the informant's mother is defendant that is still pending in the civil court. He submits that injuries have been found simple in nature caused by hard and blunt substance accept injury no. 1 and injury no.1 was not found on the vital part of the body. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 07.11.2020.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below/successor court where the case is pending in connection with Nalanda P.S. Case No. 150 of 2020.
