1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 563 of 2024 dated 04.12.2024 registered under Sections 303(2), 105, 111 of the B.N.S. 2023 and Section 3/4/5 of the Explosives Act, 1884.

3. As per the prosecution story the accused persons named in the F.I.R. are alleged to have done illegal mining of Mica by exploding the rocks. One person amongst them namely, Basudeo Bhuiyan suffered injuries due to blast and succumbed to death.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has not committed any offence in

The alleged date of incident is 02.12.2024 whereas the F.I.R. has been registered on 04.12.2024 without any plausible explanation for the delay. The petitioner is Nyay Sachiv in the Panchayati Raj Department and he was not present at the place of occurrence. It has further been submitted that on exactly similar footing the co-accused Rahul Turiya @ Rahul Turi has been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 22.08.2025 passed in Cr. Misc. No. 47647 of 2025. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the fact that the co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court and the petitioner is having no criminal antecedent, accordingly , I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nawada in connection with Rajauli P.S. Case No. 563
