====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Banka P.S. Case No. 532/2017, instituted for the offences under Sections 147, 149, 323, 337, 353 and 225(A) of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner is in custody since 03.05.2018. In the written report, it is alleged that informant along with other police party had gone to the house of this petitioner to arrest him in connection with Banka P.S. Case No. 531/2017, registered under Section 395 and 397 of the Indian Penal Code as well as Sections 3⁄4 of Explosive Substance Act, and took him in custody, but this petitioner gave Mukka blow on the

Patna High Court Cr.Misc. No.55783 of 2018 (2) dt.08-10-2018 2/2 nose of informant. In the meantime, other family members and 2530 unknown persons arrived there and got the petitioner free from confinement of the police.

Keeping in view the period of custody of petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 532/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
