The petitioner seeks bail in connection with Ahiyapur Police Station Case No. 68 of 2018 registered for offences punishable under sections 25(1-b)a/26/35 of the Arms Act. As per FIR, this petitioner and co-accused Pawan Kumar were apprehended after some chase and from the possession of the petitioner one country made pistol and two live cartridges were recovered.
It has been submitted that the petitioner has clean antecedent except one case vide Ahiyapur Police Station Case No. 447 of 2017 registered for offences under sections 379, 511 and 414 of the Indian Penal Code in which he is on bail and he is
Patna High Court Cr.Misc. No.55881 of 2018 (2) dt.28-09-2018 2/2 in custody since 22.01.2018 in the present case. Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 10thSub-Judge-cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur Police Station Case No. 68 of 2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
