Heard learned counsel for the petitioner and the learned APP for the State.

Due to non-appearance of learned counsel for the petitioner, Cr. Misc. No. 87189 of 2019 stood dismissed for want of prosecution on 08.01.2020.

It is submitted that the learned counsel for the petitioner could not appear on the date when it was dismissed for want of prosecution as he had to attend to another court and had asked some friend to seek an adjournment but when the matter was called, none appeared. It is submitted that due to inadvertence the lapse has occurred.

The court is inclined to accept the reasons as

Cr. Misc. No. 87189 of 2019 stands restored to its original file.
