JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 22-09-2016 Heard the counsel for the petitioner and the State. In the representative capacity, the petitioner has filed the present writ application for a direction upon the respondents to enquiry into the irregularities committed in laying the road under package no.BR 28R-299 taken up under the Pradhan Mantri Gramin Sadak Yojna from village Nendua to Bari Nahar Jiran (Jigani). It is alleged that in the construction of the said road substandard materials are being used. It was being done in connivance with the local officials.
The State respondent(s) by filing counter affidavit have denied the said contention of the petitioner. On the basis of a report called for considering
Patna High Court CWJC No.3476 of 2014 dt.22-09-2016 2/2 the complaint of the petitioner, it is stated that the Superintending Engineer on verification has reported that the work was being carried out under the said Yojna according to the specification(s).
Be that as it may, if the petitioner is raising a public grievance with regard to substandard work being executed by the said authority under any government scheme/Yojna, he has a remedy to invoke the jurisdiction of the appropriate authority under the new Act enforced in the State of Bihar for redressal of such public grievance(s).
Granting the said liberty to the petitioner, the writ application is disposed of.
