The petitioner apprehends arrest in a case under sections 420, 467 and 474 of the Indian Penal Code. The informant Brahamdeo Prasad Gupta, Branch Manager of State Bank of India has alleged in the F.I.R. that the petitioner was working as Customer Assistant in the said Bank who on 18.11.2014 issued two S.T.D.R. of Rs. 50,000/- each about which the informant came to know on 18.2.2015. It is alleged that both the S.T.D.R. were signed by the petitioner whereas he was not authorized to sign the same. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The case has
Patna High Court Cr.Misc. No.20557 of 2015 (2) dt.25-06-2015 been instituted against the petitioner due to mistake of fact and the same is evident from perusal of annexure-3. It is submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs.10,000/- (Rupees ten thousand) in the court below which will be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, the petitioner is directed to deposit Rs.10000/- (Ten thousand) in the court below which will be subject to final disposal of the case and on his doing so, in the event of arrest or surrender of the petitioner, above named, within four weeks from the date of receipt/production of a copy of this order, the court below shall enlarge him on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 60 of 2015, subject to all the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Sudhir Singh, J) Amin/- U
