JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioners were caught by the police and seized two motorcycles but admittedly, the seized motorcycles are not the subject property of the present case. Moreover, it is alleged that petitioners confessed that they had sold the stolen motorcycle to one Jayshankar Tiwary but the impugned order does not reflect as to whether the stolen motorcycle has been recovered or not. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakia P.S.
