JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 342, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code in which cognizance has been taken under Sections 147, 148, 149, 341, 342, 323, 379, 504 and 302 of the Indian Penal Code Prosecution allegation, in short, is that the father of the informant was assaulted by the accused persons due to which he sustained injuries and later succumbed to the injuries. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The name of the petitioner has transpired merely on the basis of disclosure made by co-villager whose name has not been disclosed by the prosecution. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the alleged occurrence. There is no eye witness to the alleged occurrence.

On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 50/2022.
