The statement of victim appears to have been recorded under section 164 of the Cr.P.C., in which she specifically stated that she was kidnapped and raped by the petitioner. The victim appears to be minor.

Considering the aforesaid facts and circumstance as well as submission of the parties, I am not inclined to grant privilege of bail to the petitioner and, hence, his prayer for bail in connection with Sessions Trial No.77 of 2016/112 of 2016, arising out of Paraiya P.S.Case no. 75 of 2015, pending in the court of learned VIth Additional Sessions Judge, Gaya, stands rejected.
