JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379/411 of the Indian Penal Code.

Petitioner is said to have been caught by the informant when petitioner was trying to commit theft in his Beauty Parlor and one stolen mobile is said to have been recovered from conscious possession of the petitioner but according to the prosecution case itself, the aforesaid mobile does not belong to the informant. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 17.5.2016.

Accordingly, the petitioner above named is directed

Patna High Court Cr.Misc. No.33794 of 2016 (2) dt.18-08-2016 2/2 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional C.J.M.II, Supaul in connection with Chhatapur P.S. Case No.128 of 2016.
