The petitioner seeks bail in connection with Pipra P.S. Case No. 263 of 2017 dated 17.10.2017 instituted for the offence under Section 392 of the Indian Penal Code.

The informant is stated to have been divested of approximately Rs. 70,000/- which he was carrying with him.

The FIR has been registered against unknown.

The name of the petitioner has transpired in the confession of one Upendra Kumar whereafter he was taken into custody.

Learned counsel for the petitioner has submitted that other similarly situated co-accused

Patna High Court Cr.Misc. No.54492 of 2018(2) dt.04-09-2018 2/2 persons have been granted bail by different Benches of this Court.

The petitioner has been made accused in similar nature of cases, but almost all the cases are on the basis of confession of co-accused persons and in all such cases, the petitioner is on bail.

Regard being had to the aforesaid facts as also the period of custody of the petitioner which is from 18.05.2018, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S. Case No. 263 of 2017.
