JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Trial No. 2107 of 2019 arising out of Complaint Case No. C-2/1050 of 2016 for offences under Sections 323 and 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner would submit that the petitioner is ready to keep his wife with full honour and dignity.

Considering the aforesaid and in order to restore normalcy in conjugal life between the petitioner and opposite party no.2, this Court is inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.56544 of 2019(6) dt.12-06-2020 2/2 Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge,West Muzaffarpur in connection with Trial No. 2107 of 2019 arising out of Complaint Case No. C-2/1050 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

After release of the petitioner, the matter may be referred to the District Mediation Centre and the petitioner and opposite party no.2 will appear before the Mediation Centre so that the dispute may be amicably settled between the husband and wife.
