The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged by the Circle Officer, Paroo that the petitioner took away the fallen 'Bargad' tree from the campus of middle school without any valid authority.

It is submitted by learned counsel for the petitioner that neither there is anything on record to suggest that the petitioner committed theft nor any recovery has been made from the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.21021 of 2015 (2) dt.19-05-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Paroo P.S. Case No. 1 of 2015, pending before the learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur.

With the above observation, this application is, accordingly, disposed off.
