JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant is not an eye witness of the alleged occurrence and he expressed his suspicion against the petitioner and some others as the son of petitioner was allegedly killed by informant's brother namely, Ashok Chouhan and for the aforesaid incident Khizer Sarai P.S.Case No. 240 of 2012 had been lodged. The aforesaid Ashok Chouhan got bail in the above stated case and after that the father of the informant was killed. The impugned order goes to show that in course of investigation, some witnesses suspected the involvement of the petitioner and others. Moreover having similar allegation, co-accused Dhelphekwa Chauhan @ Feku Chauhan has already been granted privilege of bail.

No.37668 of 2016 (2) dt.09-09-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrat-III, Gaya in connection with Khizer Sarai P.S.Case No. 258 of 2015.
