The petitioners seek bail in Daraunda P.S. Case No. 127/2018, instituted for the offences under Sections 379, 411 and 414 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner has clean antecedent.
It is alleged in the written report that informant had parked his motorcycle on the door and gone to see Tilak ceremony. When he returned, he saw one person was running away with his motorcycle. The informant raised alarm and chased him by other motorcycle and caught hold him at Parauli More. In the meantime, two other persons came on other motorcycle and started helping the person who was running away with the motorcycle of informant. It is
Patna High Court Cr.Misc. No.54044 of 2018 (2) dt.04-10-2018 2/2 further alleged that other relatives and villagers came there and caught the accused persons. The villagers assaulted the accused persons. The documents were demanded from accused persons then they could not produce the documents for the same. The apprehended accused persons disclosed their name as Rudal Sah (petitioner no. 1), Ravi Kumar Sah and Ranjan Yadav (petitioner no. 2). Thereafter, the accused persons were produced before the police. In the written report, informant has stated that unknown person has taken away his motorcycle. Later on, three persons were apprehended by informant and villagers. They disclosed their name after being assaulted by the villagers.
Petitioners are in custody since 02.07.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Siwan in connection with Daraunda P.S. Case No. 127/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
