18-06-2015 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Sakra P.S. Case no.42 of 2015, registered for the offence under Sections 406, 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that as per agreement to sell the land, the same was already transferred by the petitioner to the informant and subsequently due to execution of sale deed by another person, the informant has implicated the petitioner as accused. He further submits that as per F.I.R. itself, the advance amount was given by the informant in the year 2011, however the present case was lodged in the year 2015.

Let the petitioner, namely, Vinod Singh, in the event of his arrest or surrender within a period of one month from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case no.42 of 2015, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U T
