IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.31658 of 2016 Arising Out of PS.Case No. -218 Year- 2014 Thana -MOTIHARI TOWN DistrictEASTCHAMPARAN(MOTIHARI) ======================================================

1. Shambhu Prasad S/o Baiju Prasad Resident of Amlapatti, P.S. Motihari Town Dist East Champaran.

.... .... Petitioner

Versus

1. The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Sangeet Deokuliar For the Opposite Party/s : Mr. Md. Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier twice rejected vide order dated 20.01.2015 and 07.10.2015 passed in Cr. Misc. No,. 32787 of 2014 and 18936 of 2015 and further the petition for Special Leave to Appeal (Crl.) No. 2701 of 2015 was also dismissed as withdrawn by the Apex Court.

In view of the report of the trial court that at least four months time will be required in conclusion of this session trial if the prosecution and defence cooperate the court for disposal of the case. So, I see no reason to review the earlier order refusing bail to the petitioner.

In the result, finding no good ground for

Patna High Court Cr.Misc. No.31658 of 2016 (3) dt.16-09-2016 reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected in S. Tr. No. 611 of 2015 arising out of Motihari Town P.S. Case No. 218 of 2014 as he is one of the assailant.

However, the trial court is directed to conclude the trial within four months as required by him.
