JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Revilganj P. S. Case No. 139 of 2019 disclosing offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Prosecution case is that police intercepted a vehicle which appears to be stolen one but the petitioner succeeded in fleeing away. It appears that the name of the petitioner disclosed by the accused persons, who has succeeded in fleeing away from there. There is recovery of 261 liters of liquor from the house of the accused Vinod Singh and the name of the petitioner surface on the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the
Patna High Court CR. MISC. No.53580 of 2019(2) dt.27-08-2019 2/2 petitioner and the recovery is from the house of co-accused Vinod Singh.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-11th,-cum- Special Judge (Excise), Saran, in connection with Revilganj P. S. Case No. 139 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
