The petitioners apprehend their arrest in Agiaon Bazar P.S. Case No. 29 of 2015, registered for the offences punishable under Sections 420 and 406 and other Sections of the Indian Penal Code.
The informant made allegation that she owned land of Khata No. 61, but the petitioner showing her dead got the land mutated in their names.
Learned counsel for the petitioners submits that the husband and father of the petitioner Gajendra Rai purchased the land from Jag Dayal Rai and Ram Suresh Rai and the petitioners did not get their names mutated fraudulently. By mere
Patna High Court Cr.Misc. No.21655 of 2015 (2) dt.08-07-2015 2/2 getting names mutated, one person cannot get the title. Considering the facts aforesaid and the nature of allegations, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Smt. Rachana Raj, the learned Judicial Magistrate 1st Class at Ara in Agiaon Bazar P.S. Case No. 29 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
