The petitioner is accused in connection with Jamhore P.S. Case No. 98 of 2015 registered under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, his name has surfaced on the basis of confessional statement of co-accused, Gandhi Choudhary, having hand in the alleged offense and thereafter, petitioner surrendered on 02.07.20108 since then he is in jail custody. It is further submitted that while informant has claimed to identify the two miscreants but petitioner has not been put on T.I. Parade and
Patna High Court Cr.Misc. No.53934 of 2018(2) dt.19-09-2018 2/2 except confessional statement of Gandhi Choudhary, no any tangible evidence has been collected by the Investigating Officer to show the involvement of the petitioner in the present case. It is further submitted that petitioner is accused in one another case.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Jamhore P.S.
