The petitioner seeks bail in a case registered under Section 7(a) of Prevention and Corruption Act. Allegation is that the petitioner had demanded Rs.25,000/- from the complainant/informant as bribe. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.03.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be the Karamchari of the Block. He has been made accused in
Patna High Court CR. MISC. No.50336 of 2019(2) dt.14-08-2019 2/2 connection with trap case. Rs.24,000/- is alleged to have been recovered in the trap case. Due to politics the petitioner has been made accused in the present case. No procedure of trap has been followed. It is further submitted that the petitioner is ready to deposit an amount of Rs.1 lakh in the court below, which shall be subject to final disposal of the case.
On behalf of the counsel for the vigilance, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs.1 lakh in the court below, which shall be subject to final disposal of the case. On doing so, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-II, Patna in connection with Special case No.06 of 2019 arising out of Vigilance P.S. case No.14 of 2019.
