JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 393 of the Indian Penal Code. Petitioner is in jail custody since 15.04.2016 on the accusation that he gave lift to the informant in his car and instead of taking him to his destination the petitioner diverted the route which caused apprehension to the informant and in the meantime, police reached there and caught the petitioner. Submission on behalf of the petitioner is that even if the prosecution story as propounded by the informant assumed to be true, then also, Section 393 of the Indian Penal Code is not made out and as a matter of fact, none of the sections of Indian Penal Code is applicable in the present case.

No.33716 of 2016 (3) dt.17-10-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S. Case No. 84 of 2016.
