Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of I.P.C. The petitioner is husband of the victim of dowry death. He is in custody since 23.04.2018.

In the past, prayer for bail to the petitioner was refused on 19.04.2019 vide order at Annexure-1. The case is still running for prosecution evidence.

Considering the period already undergone by the petitioner as undertrial prisoner and no chance of early conclusion of the trial in near future, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where

Patna High Court CR. MISC. No.8400 of 2021(3) dt.10-03-2021 2/2 the case is pending in connection with S.Tr.No.726 of 2018 arising out of Aurai (Muzaffarpur) Police Station Case No.61 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
