It is nothing but taking a chance or if not gambling with the system.
He is looking for pension, gratuity etc. which cannot be made available to him for the reason that the petitioner resigned from service and his resignation was accepted way back on 18th of August, 2003.
This position also stands certified from Annexure-B, which is the order passed in the earlier writ application of the petitioner.
Patna High Court CWJC No.3716 of 2014 dt.30-01-2016 2/2 Counter affidavit indicating that position has been filed by the State and is placed on record.
The Court was inclined to impose heavy cost upon the petitioner for wasting valuable judicial time and burdening the system. However, on earnest prayer made by the counsel for the petitioner, he is let off with caution and warning. Writ application stands disposed off.
