ANJANA MISHRA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioners, informant and learned counsel for the State.

The petitioners apprehend their arrest in connection with Saharsa Sadar P.S. Case No. 813 of 2014 registered for the offences punishable under Sections 341, 323, 302, 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that entire family has been roped into the present case on account of previous enmity. It is further submitted that there is no specific allegation of attacking the deceased against the petitioner nos. 1 and 3 whereas the petitioner no. 2 is concerned, it is alleged that he also participated in the attack on the deceased.

Considering the general allegation made against the petitioner no. 2 and also the fact that petitioner nos. 1 and 3 are ladies, who are alleged to have beaten the deceased by hands and fists only, let the petitioners above named, in the event of

No.21509 of 2015 (3) dt.21-09-2015 their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 813 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
