2. The present application has been filed on behalf of the petitioner for grant of regular bail in connection with Rosera P.S. Case No. 131 of 2026, for the offence punishable under Sections 340(2) and 3(6) of the B.N.S., 2023 along with sections 30(a) and 36 of the Bihar Prohibition and Excise Amendment) Act, 2022.

3. As per the prosecution case, on secret information received that a white pickup vehicle was transporting illicit foreign liquor hidden inside a generator box and on search total 691.50 litres of foreign liquor was recovered. This petitioner was apprehended on the spot.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is no way connected to the present case. From perusal of FIR, it is clear that the petitioner is merely a driver. The said pickup vehicle was hired by a person namely, Mukesh Kumar, who loaded the generator set onto the vehicle. The petitioner was instructed to follow his car. When the police intercepted, the petitioner intercepted the pickup, Mukesh Kumar fled the scene in his car.

It is submitted that nothing incriminating has been recovered from the conscious possession of the petitioner and the petitioner had no knowledge or control over the contraband hidden inside the generator box by the hirer, Mukesh Kumar. The petitioner has clean antecedent and he is in custody since 05.04.2026.

6. Learned APP for the State has vehemently opposed the prayer for bail.

7. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. The petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of

(ii) Petitioner will co-operate in the trial and will remain present on all dates personally or should be duly represented through his counsel and whenever required to be physically present by the court, he should physically appear in the Court on that date.

(iii) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
