JUSTICE RAJIV ROY ORAL ORDER 11-08-2025 Heard Mr. Hemant Ray, learned counsel for the petitioner in Cr. Misc. No. 49904 of 2025 and Mrs. Sunidhi Vimal, learned counsel for the petitioner in Cr. Misc. No. 53343 of 2025 as also learned APPs representing the State.
2. The petitioners are in custody in connection with Shri Krishnapuri P.S. Case No. 292 of 2024 for the offence punishable under sections 304(2) of the B.N.S., lodged on 01.10.2024 by the informant, Sarita Devi.

As per the prosecution story, the informant alleged that on 01.10.2024 at 06:10 AM while she was returning after dropping her son, near Shakuntalam Apartment, accused persons on a motorcycle snatched the gold chain from her neck and ran towards S.K. Puri. As it was weighing 25 gram costing Rs.1,60,000/-, the F.I.R.

Learned counsels for the petitioners jointly submit that they have been repeatedly implicated by the Police which shows from paragraph no.3 of the petition as both have 10/14 criminal antecedent under their belts. The submission is that they are in custody since January, 2025 and to the best of their knowledge, the charges have been framed. The last submission is that Amit Kumar who has also been made accused and have 13 criminal antecedents has been granted bail by a coordinate Bench in Cr. Misc. No. 48832 of 2025 on 08.08.2025.
5. Let the order be kept on record.
6. Learned APPs opposes the prayer for bail submitting that both have number of criminal antecedent of different jurisdiction in Patna, mainly of Shashtri Nagar Police Station.
7. Though at first, this Court was not inclined to extend them privilege of bail considering the number of cases,
3/4 in view of the fact that coordinate Bench has granted relief and it has come into the order itself that the accused Amit Kumar was having 13 criminal antecedent, in that background and since he has been granted bail after framing of charge, information has been given that the charge has already been framed, accepting the said word, this Court is inclined to extend them the privilege of bail with conditions.
8. However if it is found that the statement regarding framing of charge is incorrect, the order shall become infructuous.

Let the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna, in connection with Shri Krishnapuri P.S. Case No. 292 of 2024, subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official document to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
4/4 (iii) the petitioners shall appear before the concerned police station every fortnight for one year to mark their attendance;
(iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds.

Having recorded the order, this Court would direct the office to send a copy of the order to the office of Senior Superintendent of Police, Patna to look into the matter that the accused persons involving in the case having more than ten cases relating to prominent area of Patna are not either under watch nor appropriate steps taken against them in accordance with law as a preventive measure. Further, the Station Head Officer, Shashtri Nagar Police Station has a lot to explain why the incidents are repeatedly happening in such area. (Rajiv Roy, J) vinayak/- U T
