I do not find that a case for quashing of the First Information Report in exercise of power under section 482 of the Code of Criminal Procedure is made out in the facts and circumstances of the case.

However, in view of the submissions advanced on behalf of the petitioner, this application is disposed of with an observation that the petitioner shall have the liberty to raise the issue, as raised in the present application, at the stage of taking cognizance or framing of charge, as the case may be.
