====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 12-08-2025 Heard Mr. Rakesh Mohan Singh, learned counsel appearing on behalf of the petitioners and Mr. Jitendra Kumar Singh, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Parsa P.S. Case No. 92/2024 registered for the offence(s) punishable under Sections 147, 149, 188, 341, 323, 324, 307, 353, 332, 333 and 506/34 of the Indian Penal Code and Section 3⁄4 of Public Property Damage Act.
3. As per the allegation made in the FIR, the accused persons (29 named and 40-50 unknown persons) were blocking the road with dead body of one Jaipal Singh, who died due to
Patna High Court CR. MISC. No.51244 of 2025(2) dt.12-08-2025 2/3 electric shock and when the police party came and requested to remove the blockade, they started hitting the police party with bricks, stones and sticks. The crowd present there also set the road on fire and disrupted the traffic.
4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. General and omnibus allegation has been levelled against the petitioners and at best, petitioners can only be said to be members of the mob. Similarly situated co-accused have already been granted bail by this Court vide order dated 01.05.2025 passed in Cr. Misc. No. 23041 of 2025.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the rival submissions made on behalf of the parties, as well as, the fact that general and omnibus allegation has been levelled against the petitioners and petitioners can only be said to be members of the mob, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand)
Patna High Court CR. MISC. No.51244 of 2025(2) dt.12-08-2025 3/3 each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Saran, Chapra in connection with Parsa P.S. Case No. 92/2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
7. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
8. The bail application stands disposed of.
