The petitioner apprehends his arrest in Bathnaha P.S. Case No. 142 of 2014, registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code.
The informant Ram Sewak Mukhiya named the petitioner and other accused persons and alleged that they all assaulted him. The petitioner Brij Kishore Mukhiya is alleged to have assaulted the informant with Pharsa on his head. Learned counsel for the petitioner submits that two injuries are found on the body of the informant and both the injuries are caused by hard and blunt object and simple in nature. No injury by Pharsa is found on the body of the informant. The
Patna High Court Cr.Misc. No.16182 of 2015 (2) dt.30-04-2015 2/2 occurrence took place on account of land dispute. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 142 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
