The petitioner is in custody in connection with Rajepur PS Case No. 112 of 2010 for the offence under Sections 147, 148, 149, 341, 342, 323, 324, 307, 427, 436, 504 and 379 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has been made accused in the instant case on confessional statement of the co-accused and is in custody since 12.03.2018. The co-accused persons, namely, Baidh Nath Ram, Rajesh Ram, Sanjay Kumar @Sanjay Prasad, Dilip Kumar Sah, Dhanajay Jha @ Dhananjay Kumar Jha and Suresh Ram have been granted bail.

No.54873 of 2018(2) dt.28-09-2018 2/2 Considering the fact that the co-accused have been granted bail and keeping in view the period of incarceration, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each after 21.10.2018 to the satisfaction of the Sub Divisional Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Rajepur PS Case No. 112 of 2010.
