JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.
Petitioner is named in the first information report and according to prosecution case itself, petitioner and other F.I.R. named accused took the deceased from his house and subsequently, after three to four hours they threw his dead body in front of his house.
Submission on behalf of the petitioner is that having similar allegation, several co-accused have already been granted privilege of bail by different Benches of this Court. It is further submitted that except suspicion, there is nothing against the
Patna High Court Cr.Misc. No.28558 of 2016 (2) dt.18-07-2016 2/2 petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No. 61 of 2015.
