11-09-2018 Heard Sri Ramesh Kumar Singh, learned counsel for the petitioners. None appeared on behalf of State. Two petitioners, apprehending their arrest in Mahila (Araria) P.S. Case No. 56 of 2018 registered for offence under Sections 376/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that petitioner no. 1 is an old person and so far as petitioner no. 2 is concerned, she is lady and as such, this Court may extend the privilege of anticipatory bail.
Besides hearing, I have perused the F.I.R. and after going through the same, it appears that though, there was serious accusation in the F.I.R., the provision of law has only
Patna High Court Cr.Misc. No.54030 of 2018(2) dt.11-09-2018 2/2 been incorporated as Section 376/34 of the Indian Penal Code. Considering the accusation in the F.I.R., I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
