2. The petitioners seek regular bail in connection with Fatehpur P.S. Case No. 07 of 2024, registered for the offence under Sections 457, 380 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are accused of committing theft.

4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence. The petitioners are having six criminal antecedents and they are in custody since 07.06.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.

7. Let the petitioners above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kishanganj in connection with Fatehpur P.S. Case No. 07 of 2024, subject to the condition that the petitioner no. 1 will mark his attendance at Terhagacch Police Station on every Sunday of each month whereas petitioner no. 2 will mark his attendance at Palasi on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioners.
