The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018. It is a case of recovery of about 90 liters of country made wine from a tempo.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has no concern with the seized vehicle and no liquor was recovered from the conscious or constructive possession of the petitioner and petitioner has not been arrested at the spot. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.2383 of 2021 arising out of Chowk P.S.
